Medicaid/Medicare and Disability Law
Medicaid, Nursing Homes and Long-Term Care
The costs of major illness can place financial strain on people of all economic means. Attorney Peter M. Macy can help you to protect your home and life savings if such an illness should occur in your family. In addition to prudent uses of trusts and wills for advance planning, Mr. Macy and his seasoned staff can help seniors and their families to use their existing resources to get the most comfortable care possible. If Medicaid is available to assist with financing, Mr. Macy can help you to apply and to protect your rights in that process.
Mr. Macy offers a free initial phone consultation during office hours, which are Monday-Friday, 8:30 a.m.-6:30 p.m. Call 617-742-9310 to learn more.
Planning Ahead
It is almost never too soon to think about how you would handle the cost of a long-term illness. In general, nursing home, assisted living and home-care costs are not insured under Medicare or other medical insurance. The cost of specialized "long-term care" insurance is much too high for most Americans-by some estimates, more than 80% of us cannot afford it. Recent changes in Medicaid law have savaged support for middle-income seniors and their families; look-back periods and penalties have become so severe that estates under $500,000 in Massachusetts are now at much higher risk of financial catastrophe than they were before. Planning through trusts and wills can reduce that risk significantly.
Last Minute/Emergency Planning
At the same time, it is never too late make the best of a bad situation, even for those facing a long-term care crisis without prior planning. The options that remain for protecting a spouse, dependent children and heirs for whom life savings were intended are more important than ever. Mr. Macy and his staff can answer your questions and, where appropriate, recommend last-minute planning steps.
Medicaid Applications
Attorney Macy's knowledge of Medicaid law extends through the application and appeals process. His office helps people complete and file Medicaid applications, and provides advocacy for those who have been denied Medicaid already. He is experienced at all levels of the appeal process, including both administrative appeals and, if necessary, Court proceedings.
Disability Law
Attorney Macy can provide advice and representation for disabled persons who qualify for Supplemental Security Income (SSI), either separately or in connection with Medicaid. To qualify, one must be unable to perform significant, gainful work activity, and there must be a financial need as defined by both income and asset limitations. Contact Mr. Macy today if you are thinking about applying for SSI, or if you have been denied SSI benefits and would like to discuss whether an appeal makes sense for you.
