Probate of Estates and Guardianship Services

Attorney Peter M. Macy has practiced law for more than a decade in the Probate Courts of Massachusetts, providing counsel and serving as a disinterested, independent fiduciary both in the administration of estates and in protective proceedings, including guardianship, conservatorship and related matters.

Probate and Litigation of Estates

Attorney Macy represents executors and administrators in the filing and administration of estates at all levels. His office will assist as needed to:

  • Complete and file required documents
  • Serve notice and obtain appointment of fiduciary
  • Marshall estate assets
  • Take inventory of estate property
  • Account for receipts and expenditures
  • Prepare and file estate tax returns
  • Settle estate debts
  • Manage and invest estate property
  • Fulfill all other duties of the fiduciary.

Mr. Macy also serves directly as professional administrator for estates that have no heir available to serve, or where disputes among them require the services of a disinterested fiduciary.

In addition to routine administration, Attorney Macy represents parties in disputed estate matters, such as will contests, objections to accountings, removal of fiduciaries and other matters that require advocacy and courtroom appearances. Mr. Macy has substantial experience with all levels of pleading and motion practice and provides vigorous advocacy in Probate Courts throughout Eastern and Central Massachusetts

Guardianship and Conservatorship

Attorney Macy represents family members and institutions seeking to provide security and care for incapacitated, at-risk, disabled and special-needs individuals through guardianship or conservatorship proceedings. Mr. Macy's background in counseling psychology often comes into play in the evaluation of incapacity and in sorting through clinical options available to clients to provide the direct help needed by their wards.

Mr. Macy also has extensive experience helping guardians and conservators to conclude estate planning, including asset protection and Medicaid eligibility for their wards.
